PENALTIES AND SANCTIONS (Barbaros Yachting)

1) General Provision

The User/BUYER agrees that in the event of any violation of this agreement and related policy provisions, providing misleading information, abusing reservation processes, or engaging in actions that may damage the vessel/equipment/company reputation, they shall be liable to compensate all damages incurred by Barbaros Yachting.

2) Penalty Clause in Reservation and Payment Processes

2.1.If the User/BUYER cancels the reservation or refuses to receive the service after the reservation has been confirmed, outside the cancellation period specified in the contract/policy, a penalty clause may be applied.

2.2.The penalty clause may include, but is not limited to, the following items:

Non-refund of advance payment/deposit,

Loss of income due to the vessel being blocked for the relevant dates,

Operational and planning expenses,

Port, crew, and supply planning costs.

Note: Penalty rates/calculations will be clarified together with the "Cancellation-Refund Policy."

3) Fraudulent / Misleading Transactions

In case the User:

Uses false identity/contact information,

Makes unauthorized reservations on behalf of another person,

Provides false payment notifications,

Misleads company employees or vessel owners,

The Company may unilaterally cancel the reservation, withhold refunds, and, if deemed necessary, take legal action.

4) Platform Security and Abuse

In case of actions such as:

Unauthorized access attempts,

Slowing down or disrupting systems,

Data scraping or bot usage,

Attempting to exploit security vulnerabilities,

The Company reserves the right to:

Block user access,

Suspend/terminate membership,

Pursue legal remedies for damages incurred.

5) Damage to Vessel / Equipment

If the User/BUYER, intentionally or negligently:

Damages the vessel, equipment, or onboard systems,

Violates vessel rules,

Fails to comply with safety instructions,

All repair, service, parts, labor costs, and any loss of income due to vessel downtime shall be charged to the BUYER.

6) Rule Violations, Discipline, and Service Termination

In cases such as:

Disrespectful, threatening, or disruptive behavior toward crew/other guests,

Creating safety risks due to alcohol or intoxicating substances,

Engaging in prohibited activities onboard,

The captain and/or Barbaros Yachting may terminate the service partially or completely for safety reasons.

In such cases, the User shall not be entitled to any refund.

7) Defamatory Conduct and Unfair Content

If the User publishes content that:

Targets the Company with false claims,

Contains insults, threats, or defamation,

Damages commercial reputation,

The Company reserves the right to pursue legal action and claim damages.

8) Collection and Set-Off of Penalties

The Company has the right to:

Deduct applicable penalties and compensation amounts from advance payments made by the BUYER,

Request collection of any remaining balance.

9) Legal Action and Authorized Authorities

In disputes arising under this "Penalties and Sanctions" clause, the Company reserves the right to retain and share evidence such as logs, correspondence, payment records, and reservation data with relevant authorities.

10) Governing Law

This clause and all related agreements shall be governed by the laws of the Republic of Türkiye.
